Nuanic Services are provided by Nuanic Oy.

Welcome to Nuanic Oy. These Terms of Use & Privacy Policy apply to the Nuanic Ring (the “Ring”), the Nuanic App (the “App”), the Nuanic Cloud (the “Cloud”), “Software”, “Support Services”, and website (the “Site”) provided by Nuanic Oy all together referring to “Service” or “Services”. As used in these Terms of Use & Privacy Policy “Nuanic”, “Us” or “We” refers to Nuanic Oy. As used in these Terms of Use & Privacy Policy “Customer”, “Purchaser” or “Partner” refers to a party who provides the Services to its customers. As used in these Terms of Use & Privacy Policy “User” or “You” refers to a person using the Services.

About Our Service

By purchasing and/or using the Ring manufactured by Nuanic and its accompanying Software and Services, You agree to comply with and be bound by the terms of use and privacy policy outlined in this document.

The Nuanic Service includes some or all of the following parts of the Service: the Nuanic Ring, the Nuanic App, the Nuanic Cloud, and other related Services such as support or data analytics services.

The Nuanic Ring automatically collects physiological data when worn. The Nuanic App displays and stores the measurement data of the Nuanic Ring. The data is uploaded wirelessly from the Nuanic Ring to a smartphone via the Nuanic App. You also have the possibility to choose to login to the Nuanic Cloud, and then Your data is made available to You there as well. If the Nuanic Service is provided to You by a third party, such as a research institute, or if the Service is integrated into another service, please be aware that data collection and usage may vary from the information presented here. 

You acknowledge and agree that at times the Services may be inaccessible or inoperable for any reason whatsoever, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs which Nuanic may undertake from time to time without notice to You; or (iii) causes which are beyond the control of Nuanic or which are not reasonably foreseeable.

Nuanic may from time to time and in its sole discretion engage other service providers to assist in the performance of the Services, such as web hosting providers, payment processors, and other third-parties. We have no control on third-party services and do not assume any responsibility or liability for any damage or loss of any kind for or due to their content, functionality, or practices. You shall abide by the terms of use and other requirements associated with the services provided by such third-parties in connection with the Services.

Using the Service (and/or providing input information) does not give you any legal right, title or interest in the Service or related software.

If You do not agree with these terms, please do not use the Ring or the associated Services.

Privacy Policy

When purchasing or using our Services certain information is collected.

The Nuanic Ring, the Nuanic App and the Nuanic Cloud may automatically download and install updates and upgrades from time to time without further notice to You. These updates are designed to technically improve and/or enhance the Service. You agree that we may automatically deliver such updates and upgrades to You as part of Your use of the Service.

Nuanic Oy’s Services are not medical devices and should not be used to diagnose or treat any medical conditions. Nuanic’s Services are not authorized for use as critical components in life support devices or systems.

By using the Nuanic Services, You accept that we collect data from You in accordance with this Terms of Use & Privacy Policy.

What kind of personal information does Nuanic collect

We collect information that alone or in combination with other information in our possession could be used to identify You.

  • Nuanic Ring: We collect the information Nuanic Ring collects, such as DNE index, EDA signal and its components, movement, and device diagnostics.

  • When registering an account to our Services: If You choose to create an account to Nuanic Cloud we collect information required to identify Your user account, typically an email address and password. You may choose to share other information, such as date of birth, sex, occupation, nationality etc.

  • When using our Services: Nuanic Services provide features that allow users to give additional information, such as daily logs that include emotional valence, topics, descriptions, date times and other general information.

  • When accessing our Services: we automatically receive certain information about Your visit, such as:

    • Log data: data Your device automatically sends. This usually includes IP addresses, browser type and settings, date and time of Your request and other service usage information.

    • Essential cookies: cookies required to provide our Service.

    • Device information: includes name of the device, operating system, and browser You are using. Information may depend on the type of device You use and its settings.

  • Communication information: when You contact Us directly by email or other means (such as contact form on Our site), or subscribe to Our newsletter, We may collect Your name, contact information and the contents of any messages You send.

How Nuanic uses your personal information

We may use personal information for the following purposes:

  • To provide and administer access to Our Services

  • To respond to Your inquiries, comments, feedback or questions

  • To send administrative information to You (such as updates to this document)

  • To analyze how You interact with Our Services

  • To provide, maintain, improve and develop Our Services 

  • To comply with legal obligations and legal processes (see below, “Who can access Your personal information”)

In addition, we may use Your data as part of anonymous compilations, statistics and analyses for research, scientific and commercial purposes. We might use this data to enable Us to monitor, review and further develop Our products and Service, for Our internal records regarding the use of Our Service, and to support Our sales and marketing. 

Who can access your personal information

We will never disclose your personal information to any 3rd party without Your explicit consent or Your request, unless otherwise obligated:

  • Our Services: Our Services may be used by 3rd parties, such as Your employer or a research project that You participate in, or other similar situations. In such cases, Your personal information may be shared with said third parties only with Your consent.

  • Mandatory disclosures: We may be obligated by law to disclose the data we collect to certain authorities or other third parties. We may also disclose and otherwise process the data We collect in accordance with applicable law to defend Our legitimate interests, for example, in civil or criminal legal proceedings.

  • Corporate Transactions: We may disclose or transfer the data We collect in connection with the sale, merger, bankruptcy, sale of assets or reorganization of Our company or other corporate settlement.

Retaining of personal information

Nuanic Oy retains personal information for a minimum set of time, subject to legal or regulatory obligations. Storage time of customer data can be extended for legitimate business purposes. Closed and inactive user accounts are reviewed periodically and obsolete personal information is removed.

Children's privacy

Our Service does not address anyone under the age of 16. We do not knowingly collect personally identifiable information from children under 16. If our Service is provided to anyone under the age of 16 by a third party, they take the responsibility of complying with processing of personal information.

Data safety

Personally identifiable information is in a secure environment and We have taken reasonable steps to prevent unauthorized access, use, alteration, destruction or disclosure of this information.

A very limited number of individuals can access personal registers at Nuanic Oy. We take all reasonable precautions to ensure that everyone working for Nuanic Oy, who have been specifically granted access to information about You, have received adequate training to ensure that they process that information only in accordance with this policy and with Our obligations under applicable legislations.

Geolocation

Nuanic stores Your Personal Information primarily within the European Economic Area. However, We have service providers from several geographical locations. As such, We and Our service providers may transfer Your personal information to, or process it in, jurisdictions outside the European Economic Area.

Your rights and choices

In certain circumstances providing personal information is optional. However, if You choose not to provide personal information that is needed to use some features of Our Services, You may be unable to use those features.

Updating Your personal information

To update Your personal information, please log in to Your Nuanic Account and correct required corrections. If for some reason You cannot update Your information, contact Us at support@nuanic.com.

Deleting Your personal information

To delete Your account and/or personal information, contact Us at support@nuanic.com.

Request a copy of Your data

Should You wish to review the data being held by Us about You, You have the right to request details. Please make any requests in writing to Us at support@nuanic.com and We will comply with Your request promptly.

Note that You can get a copy of Your measurement data (from Nuanic Ring) through the Nuanic App and Nuanic Cloud.

Changes to this Privacy Policy

We may update Our Terms of Use & Privacy Policy from time to time. You are thus advised to review this page periodically for any changes. We will notify You of any changes by posting the new Terms of Use & Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
