This page is for informing the users of the Moodmetric smart ring, mobile application and cloud service of our Terms of Use. These include our policies regarding the collection, use and disclosure of personal information when using our Services.
'Service' in this description means the offering of Nuanic Oy related to Moodmetric technology, including the purchase of the Moodmetric smart ring, use of the Moodmetric mobile application and cloud service. If you choose to use our Service, you agree to the collection and use of information as described in this policy.
About our Service
The Moodmetric Service includes the Moodmetric smart ring (no longer available for purchase), and the Moodmetric mobile application. The Moodmetric mobile application displays and stores the measurement data of the Moodmetric smart ring.
The Moodmetric smart ring automatically collects physiological data when worn. The measurement data is uploaded wirelessly to a smartphone via the Moodmetric mobile application. You also have the possibility to choose to login to the Moodmetric cloud service, and then your data is made available to you there.
When purchasing our product or service, using our cloud service, certain information is collected.
Using the Moodmetric Service (and/or providing input information) does not give you any legal right, title or interest in the Service or related software.
The Moodmetric mobile application and Moodmetric cloud service software may automatically download and install updates and upgrades from time to time without further notice to you. These updates are designed to technically improve and/or enhance the Service. You agree that we may automatically deliver such updates and upgrades to you as part of your use of the Service.
The Moodmetric smart ring is meant for recreational purposes only. Nuanic Oy’s products are not medical devices and should not be used to diagnose or treat any medical conditions. Moodmetric’s products are not authorized for use as critical components in life support devices or systems.
By using the Moodmetric products and Service, you accept that we collect data from you in accordance with this Privacy Policy.
What data is collected
Customer information and purchases
The following information is collected for all purchases: your first and last names, your email address, company name and company registration number, telephone number, address and other contact information. We also register possible product returns and reclamations.
This information is used primarily for delivery purposes, and should we need to contact you regarding your purchase.
We keep a record of information on our customers and other contacts in order to improve our Service: how and when our customer has been in contact with us, what was the reason for the contact, and how the matter was resolved.
Measurement data
The Moodmetric smart ring measures electrodermal activity and movement. Parameters calculated from these measurements are stored in the Moodmetric mobile application.
The Moodmetric smart ring and mobile application combined provide you with measurement data to assess your well-being in terms of stress levels. We do not access your measurement data unless you login to the Moodmetric cloud service. Login to the Moodmetric cloud service is completely voluntary. It gives you the possibility to store your data (e.g. in case you lose your phone), and to easily review your data history.
The Moodmetric cloud service
Moodmetric data residing in the Moodmetric smart ring can be transferred and stored in the Moodmetric cloud service. Should you wish to do so, you need to separately agree to the terms and conditions related to accessing the cloud.
Login to the cloud requires the following information: first name, last name, and email address.
This is the background information that we store. We keep your name and email address separate from your measurement data within the Moodmetric cloud service. Only the measurement data is transferred from the mobile app to the cloud, no manually added input is transferred. For instance, diary data from the app is not stored in the cloud.
We will never disclose any identifiable information about you to a third party. We can make an exception, with your expressed consent, in a case where you wish to share your measurement data with a third party, such as a healthcare provider. In such cases we provide access for the third party in question, with strict limitations and with you having the possibility to remove the access rights at any time.
We can use your anonymous data (no name nor email address) as a part of compilations, statistics and analyses for research, scientific and commercial purposes. We might use this data to enable us to monitor, review and further develop our products and Service, for our internal records regarding the use of our Service, and to support our sales and marketing.
Retaining of personal data
Nuanic Oy retains personal data for a minimum set of time, subject to legal or regulatory obligations. Storage time of customer data can be extended for legitimate business purposes. The Moodmetric cloud service data of closed customer contracts is reviewed periodically and obsolete personal data is removed.
Log data
The Moodmetric mobile application does use third party services that may collect information used to identify you.

For error detection and resolution purposes, we collect data and information, with the use of third party products, which is called Log Data on your smartphone. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.
The Moodmetric cloud service is developed for Nuanic Oy for the purpose of storing Moodmetric measurement data. The Moodmetric cloud service data is stored on servers in Finland. Nuanic Oy does not transfer personal data outside of the EU. The cloud service provider is Yoso Oy. The cloud hosting service provider is Advania Finland.
Other possible uses of your data
Mandatory disclosures: We may be obligated by law to disclose the data we collect to certain authorities or other third parties. We may also disclose and otherwise process the data we collect in accordance with applicable law to defend our legitimate interests, for example, in civil or criminal legal proceedings.
Corporate Transactions: We may disclose or transfer the data we collect in connection with the sale, merger, bankruptcy, sale of assets or reorganization of our company or other corporate settlement.
External service providers
We may employ third-party companies and individuals due to the following reasons: To facilitate our Service, to provide the Service on our behalf, to perform Service-related services, and to analyze and market our Service.
These third parties may have access to your personal information if an agreement of non-disclosure has been signed with them. These parties are obligated not to disclose or use the information for any other purpose than what it has specifically been assigned to.

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
Children's privacy
Our Service does not address anyone under the age of 16. We do not knowingly collect personally identifiable information from children under 16. In the case we discover that a child under 16 has provided us with personal information, we immediately delete the information from our servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we will be able to take necessary actions.
Data safety
We collect and store a very limited amount of personal data. Personally identifiable information is in a secure environment and we have taken reasonable steps to prevent unauthorized access, use, alteration, destruction or disclosure of this information.
A very limited number of individuals can access personal registers at Nuanic Oy. We take all reasonable precautions to ensure that everyone working for Nuanic Oy, who have been specifically granted access to information about you, have received adequate training to ensure that they process that information only in accordance with this policy and with our obligations under applicable legislations.
Information on how to contact us to change or get copies of your data
Should you wish to review the data being held by us about you, you have the right to request details. Please make any requests in writing to us and we will comply with your request promptly.
Should you wish us to permanently delete your personal data being held by us, we will do so upon your request. We will delete all data, with the exception of the anonymized measurement data within the Moodmetric cloud service. As a consequence, we will not be able to provide the Service to you anymore.
Important notice about data security on the internet and mobile service use
The use of our Service requires a smartphone and an internet connection. You are responsible for obtaining your own internet connection, mobile and otherwise, to use our Service. You should understand that your mobile phone, computer and other electronic devices are susceptible to attack from third parties. We recommend you to use firewalls, store your passwords in a safe place, and create passwords for yourself that are strong. The security of your internet connection and/or network is your responsibility and out of our control.
Changes to this Privacy Policy
We may update our Privacy Policy from time to time. You are thus advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
